False Claims Act Suit Rejected by Court, UnitedHealth Group Seeks Damages

Justice Department claimed the insurer obtained more than $1 billion from Medicare based on inaccurate information. Judge disagreed. United counter sues.

Reuters is referenced in a Becker’s Hospital Review report.  The original False Claims Act lawsuit claimed UnitedHealth received at least $1 billion in Medicare reimbursement by submitting incorrect risk score data. The DOJ abandoned much of that lawsuit Feb. 26.

On March 23, UnitedHealth countersued the government, alleging the government breached its contract with UnitedHealth and its Medicare Advantage business. The suit was filed in a federal Los Angeles court, according to Reuters.

Jerry McElroy

Jerry McElroy worked for 35 years for Colorado’s largest integrated health care system that included an 800-member physician group. Twenty-eight of those years were spent doing government relations work for the organization. During that time, he was also closely involved with many different organizations with interests in health care and business issues such as the Colorado Association of Health Plans, the Denver Metro Chamber of Commerce, the Colorado Competitive Council, Business Council for Healthcare Competition, and the Colorado Association of Commerce and Industry. Jerry is known as one of the foremost experts on healthcare issues. He graduated from the University of Alabama in 1975 with a degree of Physician Assistant in Medicine and worked in that field for seven years before moving to the area of government relations.
